Founded in October 2017 as a Limited Liability Partnership, RSMLC is a law firm that specialises in cases relating to medical negligence. Its head office is located at Kolkata, West Bengal. RSMLC is the product of years of experience and expertise of Advocates Binota Roy and Atish Majumdar and medical practitioner Dr. Prasenjit Sarkar. As evident from the founding members itself, RSMLC seeks to combine the best of both worlds of law and medicine. The LLP seeks to cater to the needs of the medical community in a way that was always felt but never really done before.
The last few years have been witness to an exponential growth in medical negligence litigation in India. Setting up of alternative tribunals, low cost of litigation are some of the factors that have contributed to this phenomenon. While such development may be viewed by some as indication of progress and growth in consumer awareness in society, fact remains that a large number of medical negligence cases filed are frivolous. This is further attested by the fact that studies conducted by panels set up by the government has estimated that merely about 15% of medical negligence cases are genuine. However, even in such a situation, we often see cases being decided against the treating doctors due to lack of efficiency on part of the authorised representative in presenting the doctor’s case.

Ms. Binota Roy
Advocate
Ms. Binota Roy is an advocate practising in various consumer courts and tribunals across the country although primarily based in Kolkata. The law firm is mainly her brainchild. In the relatively less span of 10 years of practice, she has earned an unparalleled reputation for herself as the ‘go-to’ person for the medical fraternity in matters concerning medical negligence. She earned another full-time Master’s Degree, which happens to be an M.A. in Medical Law & Ethics from King’s College, London and returned to Kolkata to kickstart her career in litigation with special focus on defending doctors in cases relating to medical negligence.

Presently he has been designated as a Critical Care Head and Chairman, Infection Control Committee of ILS Hospital, Dum Dum. He was trained in acute medicine from Royal College of Physicians, Edinburgh, UK and received several CPD Credits approved by the Federation of Royal College of Physicians of the United Kingdom. His other area of interest is Medical Law and Ethics and is infact one of the driving forces in forming what is conceived today as Roy & Sarkar Medico Legal Consultants LLP.

Mr. Atish Majumdar, advocate, a legal practitioner holding a practising experience of 21 years in civil, criminal and medico-legal matters having appeared in numerous courts throughout the state and beyond including state and national commissions for and on behalf doctors and medical institutions. It is interesting to note that Mr. Majumdar hails from a family consisting of both physicians as well as advocates and this background has made him all the more adept in dealing with cases especially concerning medical negligence.
